1. GENERAL AGREEMENT
By purchasing a commission, you automatically agree to these Terms of Service.- Digital Only: This agreement is for digital artwork only. No physical items or prints will be shipped.- Artist Style: Work will be completed in my established art style. By commissioning me, you acknowledge that you’ve reviewed my portfolio and accept this aesthetic.-
2. PROJECT SCOPE & "SCOPE LOCK"
To keep my workflow fair and organized, I implement a Scope Lock once your brief is approved and payment is made.- The Scope: Includes only the characters, backgrounds, and details we agreed upon in our initial discussion.- Scope Creep: If you request significant additions after work has started (e.g., extra outfits, pets, or complex props), these are considered "Out of Scope." These will require a separate quote and may extend your deadline.-
3. REVISION POLICY
Revisions are designed to keep the project moving forward without getting stuck in "infinite loops."- Minor Revisions: 5 free tweaks (colors, patterns, or accessory sizes) during the sketch phase.- Simple Revisions ($10 / 500 PHP+): For minor structural or text changes. Includes 5 rounds.- Major Revisions ($25 / 1,000 PHP+): For redrawing significant parts (over 25%) or redesigning characters. Includes 1 round.-
4. PROHIBITED USE & DAMAGE FEES
- NFT & AI Ban: You are strictly prohibited from using my work for NFTs, cryptocurrency, or as training data for AI models.- Damage Fee: If this rule is broken, you agree to pay a Damage Fee of 500% of the original price. This compensates for the unauthorized use and the impact on my brand. I reserve the right to take legal action to remove the work from these platforms.-
5. USAGE RIGHTS & ROYALTIES
-Commercial Use (+100% Fee): Required if the art is used for streaming (Twitch/YouTube) or digital promotion.-Merchandising (+200% Fee): Covers physical goods (stickers, charms, etc.) up to 100 units sold.-Royalty Clause: If you produce more than 100 units, a 10% royalty on gross sales is required via a separate contract.

6. PAYMENT & CANCELLATIONS
- Payment First: Full payment is required upfront before I begin.- No Refunds: Once work starts, I do not offer refunds.- Cancellations: If you cancel before I start, a 50% "kill fee" applies. No refunds are possible once a draft or update has been sent.- Chargebacks: Unauthorized chargebacks forfeit all rights to the art, and I may resell the work.-
7. COMMUNICATION & ETIQUETTE
- Respect the Schedule: Please respect my production timeline. Frequent "status check" messages can disrupt my workflow and delay work for other clients.When to Reach Out:
- If your slot is Active, I will update you every few days.
- If your slot is Pending (not near the top of the queue), please refrain from messaging for updates.
- You are encouraged to reach out if I haven’t posted a queue update or messaged you for over 2 weeks to 1 month.Response Time: I usually respond within 6 business days depending on my current workload.-
8. TIMELINE & TRACKING
- Work Time: Generally 7–30 days depending on complexity and your spot in the queue.- Queue Tracking: You can monitor progress on my public commission board. I work on a first-come, first-served or multitasking basis.-
9. INTELLECTUAL PROPERTY
-Artist Rights: I retain full copyright and the right to use the art for my portfolio (unless a 100% Privacy Fee is paid).- Credit: Please provide clear credit to BOM / @ahtebom whenever the art is posted publicly.

10. ACKNOWLEDGMENT
- I reserve the right to update these Terms of Service at any time, and changes will be effective immediately and will notify clients of any changes to these Terms of Service via Email.- By purchasing a commission, you acknowledge that you've understood and agree to these Terms of Service, whether you've read them or not. I'm not responsible for any misconceptions due to not reading the TOS thoroughly.
